These Terms of Service ("Terms") constitute a legally binding agreement between you and Touch Grass LLC ("we," "our," or "us") regarding your use of the FOMO mobile application and the spreadfomo.com website (collectively, the "Service").

2. Description of Service

FOMO is a social platform that connects users to local events, including neighborhood activities, pickup games, social gatherings, and spontaneous meetups. Our Service helps users discover, create, and participate in local events.

3. Eligibility

To use our Service, you must:

• Be at least 13 years old
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

4. User Accounts

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your login credentials secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

6. Content and Conduct

6.1 User-Generated Content

You retain ownership of content you post, but grant us a license to use, display, and distribute it through our Service. You are responsible for ensuring your content does not violate these Terms or applicable laws.

6.2 Event Safety

While we facilitate connections between users, you are solely responsible for your safety when attending events. We recommend:

• Meeting in public places
• Informing someone about your plans
• Trusting your instincts
• Following local safety guidelines

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

8. Intellectual Property

The Service and its content (excluding user-generated content) are owned by Touch Grass LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer our Service without permission.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may also delete your account at any time through the app settings.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOUCH GRASS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Touch Grass LLC from any claims, losses, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except for small claims court actions.

14. Changes to Terms

We may modify these Terms at any time by posting updated terms on this page. Your continued use of the Service after changes constitute acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Touch Grass LLC regarding the Service.
